South Sarasota, Florida Car Accident Lawyer

South Sarasota runs along the Tamiami Trail south of the city, and the Trail is not really a street here. It is a six-lane state highway with a continuous centre turn lane, retail and medical frontage on both sides, and signals spaced far enough apart that drivers treat the gaps as open road.

Florida requires a pedestrian outside a marked crosswalk to yield to vehicles, and insurers reach for that rule immediately. It is rarely the end of the analysis. Since 2023 Florida has used modified comparative under section 768.81. A pedestrian assigned more than half the recovers nothing; below that, recovery is reduced by their share. So the argument about where someone was standing is not academic.

Florida does not require most drivers to carry insurance. A driver can be entirely at , cited at the scene, and still have no policy that pays anything toward your injuries.

The coverage that resolves those cases is usually your own uninsured and underinsured motorist protection. It is offered by de and has to be rejected in writing, so a lot of people carry it without realising. Checking what you have is worth doing before you need it, and it is the first thing I look for afterwards.

Your own coverage pays initial medical bills whoever caused the crash, and section 627.736 of the Florida Statutes requires the first treatment within fourteen days. After that those benefits are not available at all.

Sarasota Memorial sits just north of South Sarasota and is the county's only trauma programme. For injuries short of that, urgent care or your own doctor starts the same clock.
