Sarasota Hit-and-Run Accident Lawyer

The other driver is gone. The claim is not.

There is a particular helplessness to a hit-and-run. Somebody hurt you and drove away, and the ordinary machinery of a claim, exchange details, notify insurers, argue about , has nothing to attach to.

The claim still exists. It just runs through your own policy instead of theirs, and that changes almost everything about how it has to be handled.

My name is David Harris. I have handled these across Sarasota and Sarasota County since 2003.

Your PIP pays first, and it does not care who fled

Florida's no-fault benefits are not conditional on identifying anyone. Your own coverage pays your initial medical bills regardless of fault, and a driver who left the scene has not changed that.

The condition that does apply is section 627.736's fourteen-day rule: initial treatment must begin within fourteen days of the crash or the benefit is unavailable. This is where hit-and-run victims get caught more than most, because the hours after are spent dealing with police and a vehicle rather than with a doctor, and the adrenaline of the thing masks a lot. Sarasota Memorial is the county's only trauma programme; for anything less an urgent care or your own physician starts the same clock. That is not medical advice, it is a deadline.

Uninsured motorist coverage is the rest of the claim

For everything PIP does not cover, pain, suffering, the losses beyond the initial medical bills, the route is on your own policy. Florida treats an unidentified hit-and-run driver as an uninsured one, which is exactly what this coverage exists for.

Three things about it are worth knowing before you need them:

  1. It is included on Florida policies unless you rejected it in writing, so many people carry it without remembering
  2. If you insure more than one vehicle, stacked coverage multiplies the limit across them, and stacked is the default unless non-stacked was signed for
  3. It covers you as a pedestrian or a cyclist as well as in your car

Your insurer becomes the other side

This is the part that lands hardest. A UM claim is made against your own insurance company, and the relationship changes the day you file it. The company you have paid for years now decides what your injury is worth, and its interest runs opposite to yours.

Expect a recorded statement request, a demand for your complete medical history, an examination by a doctor the insurer chooses and pays, and the familiar arguments about pre-existing conditions and gaps in treatment. None of it is personal. People are simply caught off guard, because they expected to be treated as a customer.

Report it properly, and quickly

Because the claim rests on your own policy, the paperwork carries more weight than usual. Insurers scrutinise hit-and-run claims harder than ordinary ones, for the obvious reason that an unverifiable phantom vehicle is also the shape of a fraudulent claim.

So the things that feel like formalities are not:

  • Call law enforcement from the scene and get a report started. Which agency depends on where you are: the Sheriff's Office in the unincorporated county, Sarasota Police inside the city, the Florida Highway Patrol on the interstate and state roads, Longboat Key's own department on the key
  • Report it to your own insurer promptly, within whatever your policy requires, because a UM claim is a contract claim and a late notice is a defence
  • Write down everything you remember about the vehicle while it is fresh, including the things that feel useless: colour, body style, a partial plate, damage, direction of travel
  • Ask nearby businesses to preserve camera footage within days. On the Trail, Bee Ridge and the UTC district there are usually several, and they overwrite within one to two weeks
  • Keep your vehicle unrepaired until the paint transfer and damage pattern have been documented, because that is often the only physical evidence of the other car

Sometimes they are found

A partial plate, a distinctive vehicle, a camera at the right angle or a body shop noticing matching damage does resolve some of these. If the driver is identified, the claim can shift to their coverage, assuming they carried any, which in Florida is far from guaranteed.

Either way the crash report matters, and section 316.066 keeps it confidential for sixty days after filing, releasing it inside that window only to the people involved and their representatives.

Call and find out where you stand

Most people do not know whether they carry uninsured motorist coverage, or whether it is stacked. That is the first thing I look at, and it usually decides whether there is a claim at all. No fee unless you recover.
