A state highway, not a local road

Clark Road is State Road 72, and it does a job no other east-west route in the county does. It carries traffic from the Tamiami Trail across the interstate at exit 205 and then out past the edge of development toward Myakka. Along the way it passes shopping, schools, residential entrances and the interstate ramps, at speeds that stay high throughout.

I am David Harris. I have handled Sarasota County injury claims since 2003, and crashes on Clark Road are consistently among the more serious files I take.

Interchange crashes are their own category

The interchange at exit 205 mixes traffic decelerating from interstate speed with local traffic already moving at the posted limit, across a short distance and several lanes of weaving. Rear-end collisions and sideswipes in that stretch happen fast and involve vehicles that never had time to shed speed.

Jurisdiction is worth knowing here. The Florida Highway Patrol works crashes on the interstate and on state roads. The Sarasota County Sheriff's Office works the unincorporated county roads around them. A crash at an interchange can involve either, and asking the wrong agency for your report costs a fortnight.

Whichever agency filed it, section 316.066 of the Florida Statutes makes the report confidential for sixty days, with release inside that period limited to the people involved and their representatives.

Commercial vehicles change the claim

Clark Road is a freight route between the interstate and the coast, which puts commercial trucks into a share of these crashes. A claim involving a commercial vehicle is a different process from a claim against a private driver:

  • The carrier's insurer will often have an investigator at the scene the same day, while you are still at the hospital
  • Federal rules require drivers and carriers to keep logs and inspection records, and those records have retention periods that expire
  • The vehicle's electronic control module holds speed and braking data that is overwritten as the truck continues in service
  • The available coverage is usually far larger, which means the defence is usually far more thorough

Those are the cases where waiting is most expensive. A letter asking the carrier to preserve evidence has to arrive before the records cycle out.

Speed and the fault split

Since 2023 Florida has applied modified comparative under section 768.81. A claimant found more than fifty percent at recovers nothing, and below that the recovery reduces by their share.

On a road where the whole traffic stream is moving quickly, arguments about who was over the limit, who changed lanes, and who could have stopped are the substance of the case. Physical evidence and vehicle data settle them. Witness memory usually does not.

Fourteen days for treatment

Your own coverage pays your initial medical bills whoever caused the crash, provided you receive initial treatment within fourteen days as section 627.736 requires. Sarasota Memorial is the county's only trauma programme and is where a serious Clark Road crash will take you. For lesser injuries, urgent care or your own physician starts the same clock. None of this is medical advice.

Call and get a straight answer

You will reach me, not an intake line. If your crash does not need a lawyer I will tell you. If it does, I handle it myself and the fee comes out of the recovery.
