Sarasota Rear-End Accident Lawyer

The fault fight you were not expecting

A is the one crash where people assume the claim is simple. The driver behind hit the driver in front. Florida law backs that instinct: a rear driver is presumed negligent, because the duty to leave enough room sits with them.
So the insurer does not usually fight . It fights the injury instead, and it fights it with your own photographs.

My name is David Harris. I have represented people rear-ended across Sarasota and Sarasota County since 2003, and this is the single most common file on my desk.

Where they happen here

Rear-end crashes cluster where a fast road forces a sudden stop:

  • The Tamiami Trail through the city, where three through lanes brake for the same light and a stopped left-turner blocks a lane
  • The Bee Ridge Road plaza strip, where a car slows to make a driveway nobody behind expected
  • Interstate 75 approaching the Fruitville and University exits at holiday and season peaks
  • The Stickney Point approach when the drawbridge goes up and a moving queue becomes a stationary one
  • School zone tailbacks on Swift Road and Proctor at the start and end of the day

The stopped-short defence

The presumption against the rear driver can be rebutted, and there is a standard playbook for doing it. Expect some version of:

  1. You stopped abruptly for no reason
  2. Your brake lights were not working
  3. You reversed, or rolled back
  4. A third vehicle pushed the defendant into you
  5. You cut in front of them and left no room
Some of these are occasionally true. Most are asserted because since 2023 Florida has applied modified comparative under section 768.81, and every percentage point of blame shifted onto you reduces the recovery. Above fifty percent it eliminates it entirely.

The answer is rarely argument. It is the vehicle data, the damage pattern, and whether there is a camera facing that stretch of road.

The low-speed injury argument

Here is the part that surprises people most. The adjuster will put your own bumper photograph in front of a reviewer and argue that a car which sustained modest damage cannot have produced a disc injury.

It sounds persuasive. It is not a medical opinion. Occupant injury depends on the direction of force, headrest position, whether your head was turned, whether you saw it coming and braced, and your own prior condition. A stiff bumper that transmits force rather than absorbing it can produce a worse outcome for the person inside than a crumpled one.

What answers the argument is the record: treatment that started promptly, a consistent account of symptoms, and a physician documenting findings rather than complaints. That is not something anyone can reconstruct six months later.

Fourteen days, and why it bites hardest here

Whiplash and soft tissue injuries are the signature of this crash type, and they are also the injuries most likely to surface two or three days later once the adrenaline has gone. That collides directly with section 627.736, which requires initial medical treatment within fourteen days of the crash for your benefits to be available at all.

People who feel shaken but basically fine on the day are exactly the people who miss it. Sarasota Memorial is the county's only trauma programme and is not where most rear-end cases go; an urgent care along Bee Ridge or Fruitville, or your own doctor, starts the clock just as well. Nothing here is medical advice. It is a date.

What to do while it is still fresh

  • Photograph both vehicles before they move, including the undamaged parts, because the insurer will rely on those
  • Note whether the road was wet and whether the sun was low, which on the east-west roads here matters at both ends of the day
  • Ask any business whose camera faces the road to preserve the footage, in writing, within days
  • Say nothing recorded to the other driver's insurer until you know what your injuries are
  • Get the crash report when it becomes available, remembering that section 316.066 keeps it confidential for sixty days except to the people involved and their representatives

A conversation first

Call and you reach me. If your rear-end crash is one of the many that resolve perfectly well without a lawyer, I will say so. If it is one where the injury argument is already starting, that is worth knowing early. No fee unless you recover.
