Two agencies, one neighbourhood

Southgate runs along Tamiami Trail either side of Siesta Drive, and the Sarasota city limit runs through the area rather than around it. That single fact causes more confusion after a crash here than anything about the roads themselves.

A crash on one block is worked by the Sarasota Police Department. A crash a few hundred yards away, in unincorporated county, is worked by the Sarasota County Sheriff's Office. They keep separate records systems. People routinely spend a week requesting a report from the wrong one.

I am David Harris. I have handled Sarasota County injury claims since 2003, and the first thing I do on a Southgate file is establish which agency actually responded, because everything downstream depends on it.

Getting the report, and the sixty-day rule

Whichever agency wrote it, section 316.066 of the Florida Statutes makes a Florida crash report confidential for sixty days after filing. That exemption has an exception built into it for the people involved in the crash and their representatives, which is the route most of my clients use.

Sheriff's Office records sit at the Criminal Justice Center on Ringling Boulevard. City reports come through the Police Department's own records process. Neither will hand a report to an inside the window, which is worth remembering when one calls you sounding certain about what happened.

The Trail is the hazard

Tamiami Trail through Southgate is a six-lane arterial with a centre turn lane, retail on both sides, and pedestrian crossings spaced further apart than the places people actually want to cross. That combination produces a particular set of crashes: left turns across three lanes of oncoming traffic, rear-end collisions where the through lane stacks behind a stopped turning car, and pedestrians struck mid-block.

Siesta Drive adds beach traffic to it, which means a share of the drivers involved are visitors on an unfamiliar road.

What Florida law does with a contested fault argument

Since 2023 Florida has applied modified comparative under section 768.81. If you are assigned more than half the blame you recover nothing; below that, your recovery is reduced by your percentage. On a road like the Trail, where several movements conflict at once, an adjuster has room to argue you carried part of it.

That argument is usually assembled from a recorded statement taken in the first days after the crash, when you were being helpful and had not yet seen a doctor. You are not required to give the other driver's insurer a recorded statement, and there is seldom a good reason to do it early.

Fourteen days, not fourteen weeks

Florida no-fault covers your initial medical treatment through your own benefits, regardless of , but section 627.736 requires that treatment to begin within fourteen days. After that the benefit is simply unavailable.

Sarasota Memorial is minutes from Southgate and is the county's only trauma programme. For anything less serious, urgent care or your own physician starts the same clock. This is not medical advice. It is a deadline, and it is shorter than people expect.

A conversation, not a pitch

Call the office and you reach me. I will tell you honestly whether your crash needs a lawyer, including when it does not. If it does, I handle it personally and the fee comes from the recovery.
