Sarasota Distracted Driving Accident Lawyer

You saw them looking down

Almost every client who suspects distraction saw something. A driver whose head was down at the moment of impact. A car drifting within its lane and correcting. A vehicle that never braked at all, which is the signature that gives it away, because a driver who is looking at the road brakes on instinct even when it is too late.
Suspecting it and proving it are different projects. My name is David Harris, and I have handled these claims across Sarasota and Sarasota County since 2003.

What Florida law actually says

Two provisions matter and they are not the same.
Texting while driving is a primary offence in Florida, which means an officer may stop a driver for that alone. Separately, holding a wireless device is prohibited in a school zone or an active work zone. Outside those zones a driver may lawfully hold a phone for a call, which surprises people.
None of that decides your civil claim. A citation is evidence of
negligence
, not a finding of it, and no citation does not mean no case. Distraction is not limited to phones either: eating, a navigation screen, a dog in the footwell, a conversation turned toward the back seat and the infotainment system itself all produce the same crash.

Where it shows up here

  • Interstate 75 in slow-moving holiday traffic, where drivers treat a crawling lane as safe to look away from
  • Long signal-free stretches of the Tamiami Trail south of the city, which invite attention to wander
  • The UTC and University Parkway retail district, where drivers are navigating to somewhere they have not been before
  • Residential connectors like Swift Road and Webber Street at school times

The evidence, and its expiry date

This is the part that decides these claims, and every item on the list has a clock running.
  1. Phone records. Carriers hold usage detail for a limited period, and the detail that matters, data sessions and message timestamps rather than a billing summary, is usually available only through formal process. A preservation request has to reach the carrier before the retention window closes.
  2. The vehicle's event data recorder. It stores speed, throttle and braking in the seconds before impact. Whether the driver braked at all is often the single most telling fact in the file, and the module is overwritten as the vehicle continues in service or lost when it is scrapped.
  3. Infotainment and telematics. Many vehicles log paired-device activity separately from the phone itself.
  4. Cameras. Plazas along the Trail and Bee Ridge overwrite within one to two weeks.
Florida's two-year limitation period for
negligence
claims has nothing to do with any of these. It protects your right to file. It preserves none of the evidence that would prove what the other driver was doing.

Why insurers fight this one hard

An ordinary crash is an accident. A driver on a phone is a choice, and a jury responds differently to a choice. Insurers know that, which is why a distraction allegation draws a more thorough defence than the same collision without one.
Expect the argument to be turned around. Since 2023 Florida has used modified comparative
negligence
under section 768.81, so the defence looks for a share to shift onto you. Above half the
fault
you recover nothing; below it, your recovery reduces by your share. Whether you were also on a phone will be asked, and answered from your own records.

The deadlines that run regardless

Your own
personal injury protection
coverage pays your initial medical bills whoever was at
fault
, provided you receive initial treatment within fourteen days as section 627.736 requires. And the crash report stays confidential for sixty days under section 316.066, released inside that window only to the people involved and their representatives.
So in the first weeks, when the evidence is still recoverable, neither you nor the adjuster can read the official account of what happened. That asymmetry is worth understanding before you give anyone a recorded statement.

If you suspect distraction, say so early

The preservation letters that keep this evidence alive are not complicated, but they have to be sent while there is something to preserve. Call and you will reach me directly. If there is no claim worth bringing I will tell you. If there is, I handle it myself and the fee comes out of the recovery.
