The questions people actually ask
These are the ones that come up on the phone, roughly in the order they arrive. Some of the answers are shorter than you would expect.
In the first days
The other driver's insurer called already. Do I have to talk to them?
No. You are not required to give the other side's insurer a recorded statement, and there is rarely a reason to before you know what your injuries are. Early statements are useful to them precisely because they are taken while you are being agreeable and before any doctor has examined you.
They said the call is just to confirm details. Is that different?
Confirming that you were driving and where is harmless. The moment it turns to how fast you were going, whether you saw them, or how you feel, it has stopped being administrative.
How do I get the crash report?
From the agency that worked it, which depends on where the crash happened: the Sheriff's Office in the unincorporated county, Sarasota Police inside the city, the Florida Highway Patrol on the interstate and state roads. Section 316.066 makes it confidential for sixty days, released in that window only to the people involved and their representatives, so you can obtain yours while the public cannot.
I feel fine. Do I still need to see a doctor?
Personal Injury Protection
Personal injury protection (PIP) is auto insurance that pays for medical bills and sometimes lost wages after a crash, no matter who caused it. A car accident lawyer in Sarasota can help you coordinate PIP benefits with your liability claim.
About fault
The police report says the other driver was at fault. Is that the end of it?
Liability
Liability means legal responsibility for an accident and the resulting injuries. Proving liability is one of the most important jobs of a personal injury lawyer, who uses evidence like photos, witness statements, and expert reports.
They are saying it was partly my fault. Does that kill the claim?
Negligence
Negligence is the failure to use reasonable care, such as texting while driving or ignoring a spill on a store floor. Personal injury claims are built on proving that someone’s negligence directly caused your injuries.
Fault
Fault is a legal term describing who is responsible for causing an accident. Proving that another driver, property owner, or business was at fault is essential to recovering money for your injuries and losses.
There were no witnesses. Is it just my word against theirs?
Often not. Physical evidence, vehicle damage patterns, event data recorders and nearby cameras decide more of these than testimony does. The catch is that most of it has a short life, cameras along the main corridors in particular.
About money and coverage
The other driver had no insurance. Is there anything to claim?
Usually yes, through your own uninsured and underinsured motorist coverage, which Florida insurers must offer and which applies unless you rejected it in writing. Many people carry it without remembering. It is the first thing I check.
Will my own rates go up if I use my PIP?
Using no-fault benefits after a crash you did not cause should not be treated as an at-fault claim. If you are told otherwise, that is worth questioning rather than accepting.
How long will this take?
Longer than you want, and for a reason worth knowing: a claim cannot be valued sensibly until your treating doctors can say what recovery looks like. Settling before that is guessing, usually in the insurer's favour.
About whether you need a lawyer
My crash was minor and they are paying. Should I still call?
Probably not, and I will tell you so. If fault is undisputed, your injuries resolved, and the insurer is paying without a fight, a fee would only reduce what you already have coming.
When does it change?
When the injuries are not resolving, when fault is being disputed, when the other driver has no coverage, or when an offer arrives before your treatment is finished. Any of those is worth a phone call, and the call costs nothing.
