The version written for these roads
Lists like this are usually interchangeable. This one tries not to be, because two of the six steps have answers specific to Sarasota County and one of them has a deadline most people miss.
1. Call it in, and know who will come
Which agency responds depends entirely on where you are, and it decides where your report will live afterwards:
- Sarasota County Sheriff's Office for the unincorporated county, which is most of it
- Sarasota Police inside the city limits, a boundary that runs through neighbourhoods rather than around them
- Florida Highway Patrol on Interstate 75 and the state roads, which includes Clark Road as State Road 72
- Longboat Key Police on the key
If no officer attends, Florida still expects a written report to be filed in the circumstances the statute sets out, and either insurer will ask for one regardless.
2. Photograph more than the damage
Everyone photographs the dented panel. The photographs that decide claims are the other ones:
- Both vehicles in their resting positions, before anything moves
- The wider scene showing lane markings, signals and sight lines
- The undamaged parts of both cars, because the insurer will use those to argue nobody could have been hurt
- The road surface, any debris field, and the weather
- The other driver's licence, registration and insurance card rather than a written-down version
3. Get names, not just an account
Witnesses who stop are strangers. Their details will otherwise exist only inside the crash report, and under section 316.066 that report is confidential for sixty days after filing, released in that window only to the people involved and their representatives.
So a name and a number written on your phone at the scene is worth more than it looks.
4. Be seen within fourteen days
This is the step with a hard deadline attached, and it is the one people miss.
Personal Injury Protection
Personal injury protection (PIP) is auto insurance that pays for medical bills and sometimes lost wages after a crash, no matter who caused it. A car accident lawyer in Sarasota can help you coordinate PIP benefits with your liability claim.
Fault
Fault is a legal term describing who is responsible for causing an accident. Proving that another driver, property owner, or business was at fault is essential to recovering money for your injuries and losses.
Sarasota Memorial is the only trauma programme in the county, which is where a serious crash goes. For everything else an urgent care or your own doctor starts the same clock. Whether you are injured is a question for a clinician and not for me. The deadline is the part I can tell you about.
5. Preserve what will be gone next week
Nothing else on this list expires as fast:
- Camera footage from plazas along the Trail, Bee Ridge and the UTC district overwrites within one to two weeks. Ask in person, and ask soon
- Your vehicle holds event data and the damage pattern. Do not authorise disposal before it is examined
- Roadway marks survive until the next serious rain
6. Say less than feels polite
The other driver's insurer will call, often within a day or two, and will sound reasonable, because sounding reasonable is the job.
Negligence
Negligence is the failure to use reasonable care, such as texting while driving or ignoring a spill on a store floor. Personal injury claims are built on proving that someone’s negligence directly caused your injuries.
Confirm who you are and that you were driving. Decline the rest until you know more.
When to call a lawyer, and when not to
If fault is undisputed, your injuries resolved and the insurer is paying, you probably do not need one, and I will tell you so on the phone. If the injuries are not resolving, if fault is being argued, if the other driver had no coverage, or if an offer arrives before your treatment is finished, that is the point where a call is worth making. It costs nothing.
